When a client loses a case at the trial court, the
client may appeal to a
higher court. Sometimes, the trial judge makes a mistake; perhaps the
judge admitted improper evidence, or perhaps the judge's decision was
based on a misinterpretation of the law. Other times, the reason for
the appeal may be based on the client's belief that the l
aw
is unconstitutional. The client who appeals is known as the
"appellant." The attorney who assists his or her client in appealing
the case is known as the "appellate attorney."
An attorney who accepts to take your case on appeal will review the case materials, research case law, and draft the appeals papers. Reviewing the case materials includes learning about the facts of the case, reading the court transcripts, and analyzing the court's decision. Researching case law involves finding cases that support the appellant's argument. Once the attorney has completed his reading and research, he or she will draft and finalize a paper to submit to the appellate court.
